Amendments Have Been Made in the Turkish Regulation on Cosmetics
What are the Changes Made in the Cosmetics Regulation?
Some amendments have been made in the Cosmetic Regulation dated May 8, 2023, and numbered 32184, and its annexes. These are as follows:
1. The following sentence has been added to the third paragraph of article 6 (a) of the Cosmetic Products Regulation.
"However, the manufacturer may appoint a responsible person by authorizing a real or legal person established within the country in written agreement."
2. The following additional article has been added to the regulation.
"Guidelines
ADDITIONAL ARTICLE 1- (1) Guidelines necessary for the implementation of this Regulation shall be published by the Institution."
3. The second and third paragraphs of temporary article 1 of the Regulation have been amended as follows.
"(2) During the period specified in the first paragraph, it is deemed that the notification made in accordance with Article 14 of the Cosmetic Regulation repealed by Article 38 of this Regulation is in compliance with Article 16 of this Regulation.
(3) Product safety assessment to be carried out within the scope of the second paragraph of Article 13 and product information file to be prepared within the scope of Article 14 shall be completed within six months from the date this Regulation enters into force for products notified under the Cosmetic Regulation repealed by Article 38 of this Regulation."
4. In the table titled "Annex II List of Prohibited Substances in Cosmetic Products" included in the annex of the Regulation;
- Row number 1024 has been modified as follows,
"Excluding those specified in Annex VI of Regulation No 28848 (Duplicate) dated 11.12.2013 on the Classification, Labelling, and Packaging of Substances and Mixtures, 2-ethylhexanoic acid and its salts" - 30 new raw materials have been added to the list of prohibited substances after row number 1694.
5. In the table titled "Annex III List of Substances That Cosmetic Products Should Not Contain Except for the Following Restrictions" included in the annex of the Regulation;
- Rows numbered 125, 126, 158, 160, 161, 162, 163, 165, 167, 168 have been repealed,
- Rows numbered 45, 46, 70, 73, 86, 88, 109, 114, 122, 124, 131, 133, 154, 157, 175, 196, 324 have been modified,
- 45 raw materials have been added after row number 326.
The restriction imposed for newly added allergens stands out. Those who do not comply with the restriction will not be allowed to be placed on the market as of July 31, 2026, and from July 31, 2028, products containing these substances and not complying with the specified conditions cannot be kept on the Turkish market.
