What Should Companies Do?
In this context, companies whose products contain substances included in the Candidate List may have certain obligations. These can be summarised as follows:
- If a substance included in the Candidate List is present in an article at a concentration above 0.1% w/w, information necessary for the safe use of the article must be communicated to the recipient.
- Where articles containing substances included in the Candidate List are manufactured, imported or placed on the market, a notification to the HSE may be required if certain conditions are met.
- In addition, there are also information provision obligations for mixtures that are not classified as hazardous under the GB CLP Regulation but contain a substance included in the Candidate List. If a mixture contains a Candidate List substance at a concentration of 0.1% or above, a safety data sheet (SDS) must be provided upon request.
- Furthermore, where a substance placed on the market is included in the UK REACH Candidate List, the supplier is required to provide the safety data sheet for the relevant substance to its customer.
With our UK REACH service, we can help you meet these obligations.
